Legal Battle Continues: Supreme Court Declines to Halt Texas' Immigration Enforcement Law

Texas Republicans, who championed the law, argue it's necessary to combat what they perceive as an "invasion" of migrants and address border security concerns. Attorney General Ken Paxton hailed the order as a "huge win," emphasizing the law's immediate implementation.

Texas Historic Border Security Measures: A Model for All 50 States!
Texas, leveraging its State Constitutional Authority, has taken a bold step to halt Biden's open border invasion, paving the way for genuine reform. In a landmark move to fortify Texas' border security, Governor Greg Abbott signed pivotal laws to combat illegal immigration, human smuggling, and enhance border infrastructure. These laws passed between June and December, deliver comprehensive border laws and position Texas as a model for effective border management to protect Texas and America from the consequences of President Biden's border neglect. Illegal Immigration must become a state crime.
Governor Abbott emphasized the necessity of these measures, stating, "Four years ago, the United States had the fewest illegal border crossings in decades. President Biden's deliberate inaction has left Texas to fend for itself." The legislation aims to fill the void left by federal negligence.
These transformative border laws include an under-reported Senate Bill 1900, designating drug cartels as foreign terrorist organizations in Texas, further enhanced by a powerful executive order GA-42 signed in September specifically designating as foreign terrorist organizations the Sinaloa Cartel, the Jalisco New Generation Cartel, and any similarly situated Mexican drug cartels, while also urging the Biden Administration to do the same.
Texas Legislation Highlights Include:
Criminalizes illegal entry into Texas from a foreign nation, imposing penalties of up to 20 years in prison for repeated attempts, with civil immunity for enforcing officials.
Mandates a ten-year minimum prison sentence for smuggling persons and continuous smuggling, with a five-year minimum for stash house operations and intensified penalties for victim-related offenses during smuggling.
Allocates $1.54 billion in general revenue for Trusteed Programs in the Office of the Governor, specifically for border security operations and the construction, operation, and maintenance of border barrier infrastructure.
Grants state court magistrate judges the authority to issue removal orders.
Authorizes Texas military forces to use unmanned aircraft for search, recovery missions, and border monitoring under Operation Lone Star.
Expands U.S. Border Patrol agents' authority, enabling arrest, search, and seizure for felony offenses under Texas law at established border checkpoints and points of entry.
Empowers the Governor to coordinate an interstate compact for border security among interested states without congressional approval, facilitating information and resource sharing.
Establishes a collaborative border operations training program through DPS for peace officers from local law enforcement agencies, enhancing their ability to identify and prevent transnational criminal activity.
Designates Mexican drug cartels and criminal organizations as foreign terrorist organizations in Texas, increasing penalties and allowing local entities to seek public nuisance claims.
